The 2nd U.S. Circuit Court of Appeals has determined that EPA officials are not liable for giving false assurances about the air quality in New York following the 9/11 attacks. Do you agree with this ruling? Why or why not?

I submitted a question that could create some interesting fireworks on stage between Rudy Giuliani and Rep. Ron Paul, both of whom are scheduled to be in the debate. My question is the following, for Giuliani:

Rep. Ron Paul has called the 9/11 Commission Report a "charade" and supports a new investigation. Millions of Americans agree with him, including 9/11 victims' families. Do you agree, or do you believe the government has been fully honest about 9/11?

If you want Giuliani to be asked this question Thursday night and have to squirm and sweat under the Klieg lights, please vote for this question and encourage anyone you know who believes in 9/11 Truth to vote for it. If it gets enough votes to make it into the top 20 questions, it will be asked in the debate, with millions of Americans watching! ...

Today (4/25/07), during the 4 PM (ET) edition of The Situation Room, Cafferty asked the following question:

"Will 9/11 politics help or hurt Rudy Giuliani in the presidential race?"

Imagine my total shock when Cafferty (or one of his staff people) included the following reply among those to be read on the air (which Cafferty read first):

"The public is no longer fully convinced of the official story of 9/11. If Rudy expects to run on that story, he can expect incredulity. If the politics of fear is all he has, the public will abandon him in favor of politics of values, hope and truth. -- Michael"

There wasn't a peep out of Wolf Blitzer afterward.

Court Ruling May Stop 9/11 Air Quality Lawsuits

(CBS/AP) NEW YORK An appeals court ruling could spell trouble for New Yorkers suing the Environmental Protection Agency and its former chief for saying that sooty Lower Manhattan air was safe to breathe after the Sept. 11 terror attacks.

A three judge panel of the 2nd U.S. Circuit Court of Appeals declared this week that EPA Administrator Christine Todd Whitman and other agency officials can't be held constitutionally liable for making rosy declarations about air quality in the days following the World Trade Center's destruction.

The opinion, written by the court's chief judge, Dennis Jacobs, said opening EPA workers up to lawsuits for giving out bad information during a crisis could have a catastrophic side effect.

FIRE battalion chief Jim Riches brought up his son to be one of New York’s “bravest”, like him. The young Jim followed his father into the New York fire department and died at the World Trade Center on September 11, 2001.

What followed turned his heartbroken father into a relentless opponent of Rudy Giuliani, then mayor of New York. With other families of 9/11 victims, Riches has vowed to torpedo Giuliani’s prospects of winning the White House by attacking his greatest source of strength, his reputation as a hero that day.

“We’re going to follow him around the country,” said Riches. “We want all of America to know he is not the man he says he is.”

FIREFIGHTERS RIP INTO RUDY

March 9, 2007 -- The national firefighters union has drafted a blistering letter accusing White House hopeful Rudy Giuliani, whose candidacy is fueled by his 9/11 performance, of "disrespect" to FDNY members after the attacks.

The letter, drafted last week by the International Association of Fire Fighters but never released, lashes Giuliani for issues that include limiting the number of firefighters who could search for human remains at Ground Zero, and urges firefighters to say "hell no" to his candidacy.

The missive was written while the IAFF was debating inviting Giuliani to a presidential candidates' forum next week, which it eventually decided to do.

But Giuliani won't be attending because of "schedule conflicts," his aides said.

Team Giuliani countered with a statement from former firefighter Tim Brown, saying the former mayor is "honored by the support of so many first responders from across the country."

The flap came as rival Sen. John McCain hit Giuliani's turf last night, showcasing his moneyed New York-area supporters at a Town Hall-style fundraiser in Times Square.

The Firefighters' Union is holding a bipartisan election forum on March 14, 2007. They have invited several presidential candidates, but not Rudy Giuliani. Here is an excerpt of a statement from the firefighters:

"His actions post 9/11 rise to such an offensive and personal attack on our brother and sisterhood — and directly on our union — that the IAFF does not feel Rudy Giuliani deserves an audience of IAFF leaders and members at our own Presidential Forum.

The disrespect that he exhibited to our 343 fallen FDNY brothers, their families and our New York City IAFF leadership in the wake of that tragic day has not been forgiven or forgotten.

Did anyone else catch this in New York Magazine's current issue?

“I knew what they were standing on top of,” Giuliani says. “They were standing on top of a cauldron. They were standing on top of fires 2,000 degrees that raged for a hundred days. And they put their lives at risk raising that flag.”

If you're going to try to get through, you may have to disguise your question (or at least frame it in terms of his frequent invocations of 9/11). You should also have in front of you the actual transcript of what he said on 9/11:

Giuliani, a Republican who is mulling a White House run, renewed his mantle, "America's Mayor" and reminded business leaders in New Hampshire's North Country that he shepherded New York through the aftermath of Sept. 11. Even when buying cookies, a Girl Scout told him her cousin died in Iraq. Over 400 people attended the event at the Mount Washington Hotel, organizers said....

Throughout his remarks, he repeatedly returned to Sept. 11, even when mentioning immigration reform....

Journalist Wayne Barrett discussed Rudy Giuliani's run for president and his performance on 9/11, on Democracy Now yesterday. From the transcript:

"I can tell you, having just written the book, about Giuliani's performance on 9/11, that there’s a lot of 9/11 families who are outraged by his performance. You don't have to rely on me. Tom Kean and Lee Hamilton, in their own book, which came out simultaneous with mine, reported that the biggest failing of the 9/11 Commission was how they treated Giuliani at that May 2004 hearing, where they gave him a pass on every question, let him tell the same anecdotal speech he usually gets paid $100,000 to tell. And so, they said that because the families were so outraged at the pass that he was given -- and they wrote this in their own book -- they cancelled the buses to the final hearing in July or June in 2004 down in Washington. Hundreds of families that were expected to go cancelled, because they were so offended by the way in which the 9/11 Commission treated the families.

Rudy has, I’m sure, some families he can turn to that will support him for president. But there are many families who I’ve talked to in the course of reporting this book who were outraged by his performance. I mean, the city was about as prepared for that attack, despite the 1993 bombing, as apparently the Giuliani campaign was prepared for some sort of a security leak from their campaign."

Apparently, the leak may be tied to Giuliani's poll numbers early in the GOP race:

The Giuliani team does not see 9/11 or his screwing of the FDNY as problematic:
