It was a pleasure for me to meet Coleen at the Treason in America conference last week. It was somewhat sureal that, years after including her story in my film, she was rushing up to me in person, after my presentation, to shake my hand and thank me.

Dear Friends,

Today is the 8th anniversary of the terrorist attacks on the World Trade Center and the Pentagon. There are many ways that we can honor the lives lost and one of them is preventing it from happening again. Strong whistleblower protections for national security whistleblowers are the key.

I blew the whistle on the failure of the government to approve a search warrant for Zacarias Moussaoui, an al Qaeda operative who was attending flight school just weeks before the tragic attack. The flight school instructors had numerous concerns which matched up with intelligence from abroad.

Unfortunately as an FBI whistleblower, I learned the hard way what exposing this and other post 9-11 mistakes means to your career and your entire life.

Although I was honored by Time magazine in being named a Person of the Year for having blown the whistle on this terrible security lapse, I know of so many other national security whistleblowers that lost their jobs and livelihood simply by doing the right thing.

They need legal protection! They need it now!

Moussaoui appeals, calling plea invalid
Lawyers claim he pleaded guilty without seeing secret evidence

WASHINGTON — Lawyers urged Zacarias Moussaoui not to plead guilty to terrorism charges. They just couldn't tell him why.

In newly filed court documents, Moussaoui argues that court-imposed secrecy undermined his ability to present an adequate defense. His new lawyers say Moussaoui's guilty plea should be thrown out and a new trial should be convened for the man who once claimed to have been a part of the Sept. 11, 2001, terrorist plot.

Moussaoui was not allowed to see the classified evidence against him and was shut out from closed-door hearings in which that evidence was laid out.

Defense lawyers say they were barred from even discussing with Moussaoui evidence that could help prove his innocence. They say Moussaoui faced an unconstitutional choice: plead guilty or go to trial without knowing the evidence.

"Moussaoui appeals because his plea was unknowing, uncounselled and invalid," attorneys Justin Antonipillai and Barbara Hartung wrote.

WASHINGTON, D.C. -- To millions of Americans, he's the face of evil; the only man convicted for the Sept. 11, 2001 attacks.

For five years, we've seen a still picture of Zacarias Moussaoui, but WNBC.com's Jonathan Dienst has obtained the only known video of the man found to be responsible for the thousands of deaths.

The video was shot as Moussaoui was being transferred to Supermax by U.S. Marshals, a maximum-security prison in Colorado, where he will serve out his sentence of six life terms without the chance of parole.

In the tape, Moussaoui calls out "allah akbar," which translates to "God is great."

At his sentencing, when U.S. Judge Leonie Brinkema sent Moussaoui to prison for life to "die with a whimper," the convicted terrorist declared: "God save Osama bin Laden -- you will never get him."

A jury rejected the government's case to have Moussaoui executed, deciding instead to send him to prison for life without a chance of parole.

Recently-released court documents from the trial of Zacharias Moussaoui show clear evidence of the FBI attempt to cover-up the whereabouts and activities of lead 9.11 hijacker Mohamed Atta in Florida between January and May of 2001, confirming reports which have appeared exclusively in the MadCowMorningNews.

Moussaoui and the Phoenix Memo

There are various issues related to Moussaoui case, but I'd now like to take a look at its connection to the Phoenix Memo; new information appeared about this after the Moussaoui trial, as an unredacted version of the DOJ's Office of Inspector General's report into the Bureau's handling of intelligence before 9/11 was released after the Moussaoui trial. The previous version was heavily redacted and the whole chapter dealing with Moussaoui was absent. Having looked through it now, it seems fairly clear that one of the reasons (perhaps the main reason) that a FISA warrant was not sought to search Moussaoui's belongings (not just his computer), was that knowledge of the Phoenix EC did not circulate at FBI headquarters. When Moussaoui's belongings were searched after 9/11, evidence was found connecting him to two of the hijackers' associates: Ramzi Bin Al Shibh and Yazid Sufaat. It would have been a relatively simple matter to trace the hijackers in the US from Bin Al Shibh based on their phone calls, the fact that they lived with him for years and the surveillance of the Hamburg cell previously carried out by various agencies, including the CIA.
