NEW YORK — Former EPA chief Christine Todd Whitman cannot be held liable for telling residents near the World Trade Center site that the air was safe to breathe after the 2001 terrorist attacks, a federal appeals court said Tuesday.
The 2nd U.S. Circuit Court of Appeals said Whitman apparently made comments reassuring people about the safety around the site based on conflicting information and reassurances by the White House.
The appeals court said legal remedies are not always available for every instance of arguably deficient governmental performance.
A Department of Justice lawyer had argued late last year that holding the former head of the Environmental Protection Agency liable would set a dangerous precedent in future disasters because public officials would fear making public statements.
The ruling came in response to a lawsuit by residents, students and workers in lower Manhattan and Brooklyn who said they were exposed to hazardous dust and debris from the fallen twin towers after Sept. 11.
They said Whitman, who also is a former New Jersey governor, should be forced to pay damages to properly clean homes, schools and businesses.
A lower court judge had earlier refused to dismiss Whitman as a defendant, saying her actions were "conscience-shocking."

To not only deal with the criminal complicity of the Bush regime & certain Global Corporate partners in the events of 911 and its coverup but also in the cynical "negligence" of the administration and the EPA with regards of the public safety of not only the 1st Responders but the entire citizenry of the Greater New York Area that must have been affected at least by some extent by all those toxins and environmental hazards.
In a private sector situation, no corporate executive would have been excused or forgiven for a "negligence" such as this.
It is a cynical disregard for the Rule of Law with the prostitution of the Courts- the Judiciary to the Executive and its Corporate Paymasters.
Its time we get some decent Lawyers and Judges, even retired to start SPEAKING LOUD AND CLEAR about such matters so a society is not governed by the whims and fancies of blackmailers and paymasters.
Some who did not even get elected honestly in the 1st place.
They cheat in the courts, they cheat in the ballot box.
Its time we fire them.

Like so many others who supposedly 'dropped the ball' on 9/11 and who wound up moving on to higher positions, the sky may now be the limit for Whitman.
So is liable at this point?

If Whitman hadnt made her public statements in the first place, there wouldnt be a controversy.
Perhaps they should make sure that their public statements
are true before they make them, or at least not outright lies.
I find it very hard to believe that EPA staff were finding high levels of toxicity and Gov. Whitman had no knowledge of this and took the White House edited version at face value. That is just not plausible to me.
Who is this judge, anyway?

Hoping Average Americans have learned their lesson?
IMHO, it's clear, the message sent to the populace. You do not count and clearly expendible. The Average American must take the lesson away this is not a government of the people and for the people, nevertheless, to speak of God.
The Average American is a target nearly as high on the list as the oil fields in Iraq and Iran. You must look out for yourselves and do not trust in anything offered by this government.
Government has always been above liability to some extent. Christine Todd Whitman is merely part of the agenda, clearly, above accountability. It's pretty clear.
