Once again, copyright holders are trying to unmask who uploaded a potentially infringing video clip to YouTube.
This time it's Magnolia Pictures, a film distributor owned by Mark Cuban and Todd Wagner, the billionaire co-founders of Broadcast.com. Magnolia released the Academy Award-nominated documentary Enron: Smartest Guys in the Room, which has a bad habit of appearing on video-sharing sites.
Hence the subpoena to Google, which a federal court in Texas issued on Tuesday. It asks for information on how to identify the person who uploaded three videos (two on Google Video and one on YouTube).
On YouTube, at least, the username of the uploader is "halifaxion," who seems to focus on uploading video clips airing alternative explanations of what happened to the World Trade Center on September 11, 2001.
Once Magnolia is given the information that Google possesses about "halifaxion" (and it almost certainly will), the movie distributor will have the option of filing a lawsuit against that person.
As a side note, it's possible that some video-sharing sites might not keep records of users' Internet addresses. One video upload happened on October 19, 2006, and some sites could discard the address information after three months or so. A proposal from the U.S. Justice Department would change those data retention requirements and force Web sites to keep upload data for two years. The ostensible purpose is to fight terrorism and child pornography and all that, of course, but a side benefit would be to help copyright holders track infringements.
This isn't the first time that Google has been hit by a subpoena invoking the Digital Millennium Copyright Act, which permits copyright holders to find out the identities of infringers without filing a lawsuit. American Airlines sent a DMCA subpoena to Google and YouTube a year ago.

Did Halifaxion upload entire videos of copyrighted works or did he just use clips in his own videos? Halifaxion is exercising two unalienable Rights called freedo of speech and freedom of the press. His videos are a form of political speech, the most coveted of all. If he doesn't profit and uses only clips as "fair use", I don't see where Cuban has a case, except to intimidate with his resources against Halifaxion.
Has Halifaxion profited (ascension of material wealth) as a result of his videos?
I'm really curious because blogs and independently produced videos distributed on goobles are going to have a significant effect on 2008 elections, just as they have in spreading 9/11 truth. The PTB is beginning to realize this (recent apple/obama vid) and may be looking for ways to nip it to maintain control over visual content to which Americans are exposed.

3 small clips...I think about 15 mins worth of video.
I did not see the clips personally, but if I know Halifaxion they most likely were about building 7 or something tying enron to 9/11.
I have not seen that documentary yet but I will make it a point.

The clip on YouTube was a 10 minute clip with 4000+ views, that had been there for over 3 months (image below).
The thing that is so bad about this episode, is that it resulted with all his stuff being blitzed off the web.
If Cuban was neutral, I find it hard to believe he would choose Halifaxion, if Cuban was pro 9/11 Truth, then this would not have happened, what does that leave...
I hope this is just a storm in a tea cup, but always good to be aware.

If that's the concern I AM worried. Billions could keep the LC guys tied up in court for a while. I sure hope they didn't sell the right to the "Loose Change" brand (if such a thing exists), or anything similar. Such a contract could conceivably be used, even in a retro-active fashion to claim ownership or right of use - effecting all of the Loose Change vids.

Rhetorical, but why does truth need to be "legitimized" by mainstream personalities? Facts ARE facts. Science, physics, time... these don't require celebrity endorsement to be recognized for what they are.

I think we just have to have faith in Dylan, his crew, his legal council, Charlie Sheen and his friends and colleagues, to get this thing right, and strike the best possible deal for Loose Change: Final Cut.
Cuban's innovative, and money hungry and an attention whore, and maybe this is the best LTW (Louder Than Words) can do? Maybe no one else wants to touch it..? Also, Magnolia seems to have a bit of a history with documentaries. Maybe it's the best match, and we just need to have more faith, and less paranoia..?
I think when it comes out, that it will grow and grow, with more and more theaters taking it on, not wanting to get left out in the cold. Things have not been all that good for the box office of late. They need to get people coming back out, and this may be just the ticket..

Anyway, it does appear, with Sheen as narrator, that this film IS going to make it into the theaters. The only question remaining, what kind of distribution is it going to get, and will we find it on all the video store shelves after the theater run..?

Already, controversy surrounds it, and I don't think we've seen anything yet as far as that goes.
A debate is just going to RAGE around this film, if it gets wide enough distribution. But make no mistake. When it comes out, it will be self sustaining. If it's in a theater near me here in Canada, I'll watch it at least twice, as will many people.
And of course Rosie O'Donell will be plugging it on "The View". Remember how she created that "Tickle Me Elmo" craze a while back? When Rosie plugs something, for some reason, everybody does what she tells them..? (makes no sense to me why they listen to her..)

That it's not at all what you think. Hallifaxion used parts of a copywrited movie by Cuban's company, and Cuban's company also wants to pursue the leading edge, and decided to employ a new law regarding this, to set a precedent, and it worked. That Hallifaxion happened to be the number one Youtube 9/11 truth uploader may be entirely secondary, and of no consideration whatsoever. It could merely be a coincidence. We are a very paranoid lot you know, and we have every right to be, but it's also important to remain objective and open minded. Me sense is that it was a cioncidence, that Hallifaxion just happened to be the offender in the case of Magnolia's Enron movie which he uploaded parts of, and the idea behind the new law is that if you violate copywrite, you can be flushed out from the cloak of anonymity that the Net provides (provided). It's a simple matter of a practical business decision and the application of a new precedent setting law dealing with Copywrite protection from the once anonymous Youtube posters. He was made an example of, in essence. He also just happened to be the number one 9/11 video poster on Youtube. End of story.
My gut instinct tell me I'm right about this.

It's good to have known about this, and perhaps, it may be appropriate to have some concern, but it's also entirely possible that you and others are overreacting about this. Time will tell.
My argument may be sound. Think like Sherlock Holmes on this one. Think it through.
If Hallifaxion was the only one to voilate copywrite on this relatively new film distributor who wants to ride the leading edge, and they ARE into that kind of thing, with talk about simultaneous movie releases in theaters along side TV releases on Cuban's HDTV channel, for example, and who want to move quickly in terms of this new Youtube phenomenon to protect their interests, then I say it's case closed regarding your suspicions.
That said, I've heard that Cuban is a bit of a snake. Though sometimes that's simply what people call shrewd business men.
I do know that this Cuban felllow likes to make money, and that he's an attention whore. I think he's probably DESPERATE to close this deal, and I like that fact that all this publicity surrounding Sheen has thrown down a spotlight, because Dylan and Co. are STILL in negotiations with Cuban's people. One call from another suiter, and they'll be sure to get everything they want.
It's ALL good.

Like I said, show me anyone on Youtube who has part of any of Magnolia's films, and I'd be persuaded to think otherwise. Word has it that Cuban, or his company has always been a real stickler on copywrite protection. All that said, if LCFC upon release in DVD does not permit legal copying and dissemination, provided there is no profit taking from copying, then I'll be pissed, since this film is supposed to be for the truth movement, and if it's illegal, then that would mean that any copying and handing out of the film, would make of us pirates, or thieves. Robert, your coincidence theory has merit. Remeber, Cuban was making public statements against YouTube before Google bought it. He said the company was too hot for anyone to purchase, due to it's HUGE copyright problem.
Then Google purchased YouTube, which seemingly contradicted Cuban.

9/11 Truth does not live or die with any one film or any one person, so no real worries there.
If we need to, we can follow the financial model of the Italian 9/11 film ZERO and all buy shares in support of a new film. I know an excellent filmaker with a proven track record making 9/11 films who would love to make a big budget film on 9/11. The problem will always be getting it into wide distribution in mainstream theaters. The corporations that control the theaters do not want 9/11Truth to gain traction, it is not in their interests as they perceive them.
We are creating more of our own media and new channels of distribution every day, so this will soon be moot, anyway.

With the tact he chose with Bill O'Reilly. Then again, perhaps he was just kind of toying with O'Reilly, humouring him from the only possible angle that Bill could relate to, without at the same time being forced into a position to weigh in on the debate, or the voracity of our claims, so as to remain neutral...
He might have chosen a better way of describing it, however, than with his client being some sort of enemy of America and of the memory of the victims, who is better to have out in the open, than lurking in the shadows... but maybe that was the only way he figured he could approach B.O. without taking a position of any kind. Strange choice of tact though... Not a pleasant thing to hear if you're Dylan, Sheen and LTW and everyone else involved in the project..
Free speech and open debate of the issues raised, some of which may in fact have some merit, would have been by far the better way to go.
I have the feeling that Cuban, though he's made himself rich, isn't neccessarily that smart of a guy..

A couple of young guys in Holland start a new site called YoubenTuber and post Loose Change and instantly becomes a success.

Seriously, we have to use common sense with things like these. Not everything is a conspiracy.
I also think Mark's view on Loose Change is agnostic, like most people because the understanding of 9/11 is so obfuscated people are naturally skeptical. But that doesn't mean they believe the intricate conspiracy theories, just that whatever the truth is, it isn't known.

I tend to agree
with those who think Cuban is only an opportunist. If anything, regardless of what Cuban thinks, his involvement adds legitimacy to this even if his goal is to sabatoge it--which I don't think is the case. O'Reilly wouldn't have discussed it on his show unless a big name was attached to it. The fact that LC is being acknowledged, either to debunk, sabatoge, or promote is still a sign that it's no longer on the fringe, which is still big progress considering where it came from. To me it seems to be entering the second/third phases of acceptance: "violently opposing it" / "accepting it as obvious". It has to become part of the national discussion before it can be accepted, it's another step forward.
