NSPD-51 Is a Red Herring: There is ALREADY Martial Law in America
Many people have expressed outrage at NSPD-51 -- a presidential directive that gives Bush dictatorial powers in the event of a national emergency.>
For example, well-known conservative writer Jerome Corsi writes:
President Bush, without so much as issuing a press statement, on May 9 signed a directive that granted near dictatorial powers to the office of the president in the event of a national emergency declared by the president.
The "National Security and Homeland Security Presidential Directive," with the dual designation of NSPD-51, as a National Security Presidential Directive, and HSPD-20, as a Homeland Security Presidential Directive, establishes under the office of president a new National Continuity Coordinator.
That job, as the document describes, is to make plans for "National Essential Functions" of all federal, state, local, territorial, and tribal governments, as well as private sector organizations to continue functioning under the president's directives in the event of a national emergency.
The directive loosely defines "catastrophic emergency" as "any incident, regardless of location, that results in extraordinary levels of mass casualties, damage, or disruption severely affecting the U.S. population, infrastructure, environment, economy, or government functions."
When the president determines a catastrophic emergency has occurred, the president can take over all government functions and direct all private sector activities to ensure we will emerge from the emergency with an "enduring constitutional government."
Translated into layman's terms, when the president determines a national emergency has occurred, the president can declare to the office of the presidency powers usually assumed by dictators to direct any and all government and business activities until the emergency is declared over.
Ironically, the directive sees no contradiction in the assumption of dictatorial powers by the president with the goal of maintaining constitutional continuity through an emergency.
The directive specifies that the assistant to the president for Homeland Security and Counterterrorism will be designated as the National Continuity Coordinator.
Further established is a Continuity Policy Coordination Committee, chaired by a senior director from the Homeland Security Council staff, designated by the National Continuity Coordinator, to be "the main day-to-day forum for such policy coordination."

A Congressional Research Service study notes that under the National Emergency Act, the president "may seize property, organize and control the means of production, seize commodities, assign military forces abroad, institute martial law, seize and control all transportation and communication, regulate the operation of private enterprise, restrict travel, and, in a variety of ways, control the lives of United States citizens."

NSPD-51/ HSPD-20 appears to supersede the National Emergency Act by creating the new position of National Continuity Coordinator without any specific act of Congress authorizing the position.
NSPD-51/ HSPD-20 also makes no reference whatsoever to Congress. The language of the May 9 directive appears to negate any a requirement that the president submit to Congress a determination that a national emergency exists, suggesting instead that the powers of the executive order can be implemented without any congressional approval or oversight.
Most writers, like Corsi, are justifiably concerned that Bush can more or less "make up" a national emergency so as to invoke martial law authorities under NSPD-51.
However, Corsi and everyone else is missing the bigger point: Bush has already declared a national emergency. Indeed, Bush declared one in September of 2001, and has renewed the state of emergency each year up to the present. We are almost certainly already under martial law via the Continuity of Government plans(See this, this, this and this).
So what Does NSPD-51 Really Do?
My theory is that NSPD-51 serves two purposes:
(1) It consolidates all governmental power in the office of the National Continuity Coordinator; and
(2) It creates a red herring or smokescreen by phrasing a national emergency in the future-tense, when -- in fact -- America has continuously been in a state of national emergency from 9/11/01 to the present.

Thank you for bringing this issue to my attention. In particular, I was not aware that the Administration has been "renewing" the national emergency findings annually since the first set (one for the 9/11 incidents, and the second for "persons who commit, threaten to commit, or support terrorism") were originally issued in September of 2001. It now seems plainly clear, at least to me, that we have been and are still operating under COG and that NSPD-51 was exactly as you indicate it was, a red herring that also consolidates COG operations under the NCC, cutting Congress out of the loop. I can already hear the press lackey trying to explain that away by again making the insane claim along the lines of the former claim that the VP, as President of the US Senate, is "legislative enough." Actually, "hearing that" is wishful thinking on my part, since no one in the MSM who cares about their White House hard pass would DARE ask even a question as straightforward as that.

Ah Ha! Moment
I'm watching the OMB hearings on the Iraq war supplemental funding request. In every hearing on funding for the Iraq war, the money has been requested as an emergency supplemental funding request - and in every hearing, the members of Congress question, "why the emergency supplemental funding request". Why not just the regular funding stream.
Today Senator Gregg Judd, pinned Jim Nussle down on the issue of 'emergency' and he got Nussle to say that he doesn't need the word emergency in the supplemental request. But Nussle is dumb as box of rocks and I'll bet anything that his handlers in the administration are having fits tonight because .... the ah ha moment.... they need emergency war supplemental funding because the nation is in a state of emergency ..... and that means..
GEORGEWASHINGTON IS RIGHT !!!!!

It always amazes me that they can find these guys (and gals) to come out and spread the meadow muffins to the Congress and the American people.
I look forward to hearing them say " but, but, I had NO IDEA what was going on..." when they are all brought to task.
I'm going to include all of this state of emergency and CoG stuff in my weekly telephone pole postings.
We need to get this out there, brothers and sisters, for the American people to see and react to.

I just did a search on this to see what I could find on the Coordinator. I was reading a blog at the end of which, he/she put this:

Do you know why Homescam would require a separate directive from the National Security Directive? This seems odd to me.
RE: NSPD-51 and your theory
When would be the best time for 9-11 second edition to occur? How about during the period of time between the election of the new president - before he has taken the oath of office and January of the year when the previous president's term has expired - the transition of government period.
Event; NCC takes over and the inauguration never occurs. Just a thought.
